For 100 grams up to 999 grams, the penalty is no less than five years in prison and up to 40 years in prison. Fines for an individual can range up to $2 million and up to $5 million for an organization.

If an individual is charged in federal court with heroin trafficking of quantities more than one kilogram, the penalties increase substantially. The accused faces no less than ten years in prison and up to a maximum sentence of life in prison. If their actions cause death or serious injury they face no less than 20 years in prison and up to life in prison. Fines can reach up to $4 million for an individual and up to $10 million for an organization.
