Under Kentucky law, it is illegal to operate a motor vehicle with a blood alcohol concentration (BAC) of 0.08% or higher. For commercial drivers, the legal limit drops to 0.04%, and for drivers under 21, any BAC of 0.02% or higher can result in a DUI charge. Kentucky also prohibits driving while impaired by drugs, whether that be prescription, over-the-counter, or illegal substances. 

DUI penalties in Kentucky can escalate significantly with each offense. A first-time conviction can result in fines between $200 and $500, 48 hours to 30 days in jail, and a license suspension. A second offense within ten years carries up to six months in jail, fines of up to $500, and a license revocation.

By the fourth offense, a DUI becomes a Class D felony, and defendants can face more extreme penalties. If there are aggravating factors, such as a BAC above 0.15%; a minor in the vehicle; refusing to submit to blood, urine, or breath tests; or an accident that causes injuries or fatalities, penalties can begin increasing substantially.
